外籍專家聘用合同
CONTRACT

CONTRACT
Ⅰ.Party A wishes to engage the service of Party B as . The two parties, in a spirit of friendly cooperation, agree to sign this contract and pledge to fulfill conscientiously all the obligations stipulated in it.
Ⅱ.The period of service will be from the day of to the day of .
Ⅲ.The duties of Party B (see attached pages)
Ⅳ.Party B’s monthly salary will be￥ Yuan RMB, % of which can be converted into foreign currency monthly.
Ⅴ.Party A’s Obligations
1.Party A shall introduce to Party B the laws, Decrees and relevant regulation enacted by the Chinese government, the Party A’s work system and regulations concerning administration of foreign experts.
2.Party A shall conduct direction, supervision and evaluation of Party B’s work.
3.Party A shall provide Party B necessary working and living conditions.
4.Party A shall provide co-workers.
5.Party A shall pay Party B’s salary regularly by the month.
Ⅵ.Party B’s Obligations
1.Party B shall observe the laws, decrees and relevant regulations enacted by the Chinese government and shall not interfere in China’s internal affairs.
2.Party B shall observe Party A’s work system and regulations concerning administration of foreign experts and shall accept Party A’s arrangement, direction, supervision and evaluation in regard to his/her work. Without Party A’s consent, Party B shall not render service elsewhere or hold concurrently and post unrelated to the work agreed on with Party A.
3.Party B shall complete the tasks agreed on on schedule and guarantee the quality of work.
4.Party B shall respect China’s religious policy, and shall not conduct religious activities incompatible with status of an expert.

5.Party B shall respect the Chinese people’s moral standards and customs.
Ⅶ.Revision, Cancellation and Termination of the Contract
1.Both Parties should abide by the contract and should refrain from revising, canceling, or terminating the contract without mutual consent.
2. The contract can be revised, canceled, or terminated with mutual consent. Before both Parties have reached and agreement, the contract

Ⅹ.This contract takes effect on the date signed by both parties and will automatically expire when the contract ends. If either of the two parties asks for a new contract, it should forward its request to another party 90 days prior to the expiration of the contract, and sign the new contract with mutual consent.
Party B shall bear all expense incurred when staying on after the contract expires.
Ⅺ.Arbitration
The two parties shall consult with each other and mediated any disputes which may arise about the contract. If all attempts fail, the two parties can appeal to the organization of arbitration for foreign experts affairs in the State Administration of Foreign Experts Affairs and ask for a final arbitration.

外籍專家聘用合同 [篇2]
_________________聘請(qǐng)___________________籍______________________________（外文姓名）___________________（譯名）女士（先生）為_(kāi)____________________________ .
雙方本著友好合作精神，自愿簽訂本合同并保證認(rèn)真履行合同中約定的各項(xiàng)義務(wù)。
一、合同期自 年 月 日起至 年 月 日止。
二、 受聘方的工作任務(wù)（另附頁(yè)）
三、 受聘方的月薪為人民幣 元，其中 %可按月兌換外匯。
四、 聘方的義務(wù)：
1、 向受聘方介紹中國(guó)有關(guān)法律、法規(guī)和聘方有關(guān)工作制度以及有關(guān)外國(guó)專家的管理規(guī)定。
2、 對(duì)受聘方的工作進(jìn)行指導(dǎo)、檢查和評(píng)估。
3、 向受聘方提供必要的工作和生活條件。
4、 配合合作共事人員。
5、 按時(shí)支付受聘方的報(bào)酬。
五、。受聘方的義務(wù)：
1、 遵守中國(guó)的法律、法規(guī)，不干預(yù)中國(guó)的內(nèi)部事務(wù)。
2、 遵守聘方的工作制度和有關(guān)外國(guó)專家的管理規(guī)定，接受聘方的工作安排、業(yè)務(wù)指導(dǎo)、檢查和評(píng)估。未經(jīng)聘方同意，不得兼任與聘方無(wú)關(guān)的其他勞務(wù)。
3、 按期完成所在學(xué)院的教學(xué)、科研任務(wù)，保證工作質(zhì)量，并參與一定數(shù)量的校內(nèi)其它學(xué)術(shù)活動(dòng)和社會(huì)工作。
4、 尊重中國(guó)的宗教政策。不從事與專家身份不符的活動(dòng)。
5、 尊重中國(guó)人民的道德規(guī)范和風(fēng)俗習(xí)慣。
六、 合同的變更、解除和終止：
1、 雙方應(yīng)信守合同，未經(jīng)雙方一致同意，任何一方不得擅自更改、解除和終止合同。
2、 經(jīng)當(dāng)事人雙方協(xié)商同意后，可以變更、解除和終止合同。在未達(dá)成一致意見(jiàn)前，仍應(yīng)當(dāng)嚴(yán)格履行合同。
3、 聘方在下述條件下，有權(quán)以書(shū)面形式通知受聘方解除合同：
（1） 受聘方不履行合同或者履行合同義務(wù)不符合約定條件，經(jīng)聘方指出后，仍不改正的；
（2） 根據(jù)醫(yī)生診斷，受聘方在病假連續(xù)30天后不能恢復(fù)正常工作的。
4、 受聘方在下述情況下，有權(quán)以書(shū)面形式通知聘方解除合同：
（1） 聘方未按合同約定提供受聘方必要的工作和生活條件；
（2） 聘方未按時(shí)支付受聘方報(bào)酬。
七、 違約金：
當(dāng)事人一方不履行合同或者履行合同義務(wù)不符合約定條件，即違反合同時(shí)，應(yīng)當(dāng)向另一方支付500—2000美元（或相當(dāng)數(shù)額的人民幣）的違約金。
受聘方因不可抗力事件要求解除合同，需出具有關(guān)機(jī)構(gòu)證明，經(jīng)聘方同意后，離華的費(fèi)用自理；受聘方若無(wú)故解除合同，除離華費(fèi)用自理外，還應(yīng)當(dāng)向聘方支付違約金。
聘方因不可抗力事件要求解除合同，經(jīng)受聘方同意后，離華費(fèi)用由聘方負(fù)擔(dān)；聘方若無(wú)故解除合同，除負(fù)擔(dān)受聘方離華費(fèi)用外，還應(yīng)當(dāng)向受聘方支付違約金。
八、 本合同附件為合同不可分割的一部分，與合同具有同等效力。
九、 本合同自雙方簽字之日起生效，合同期滿即自行失效。當(dāng)事人一方要求簽訂新合同，必須在本合同期滿90天前向另一方提出，經(jīng)雙方協(xié)商同意后簽訂新合同。
受聘方合同期滿后，在華逗留期間的一切費(fèi)用自理。
十、 仲裁
當(dāng)事人雙方發(fā)生合同糾紛時(shí)，盡可能通過(guò)協(xié)商或者調(diào)解解決。若協(xié)商、調(diào)解無(wú)效，可向國(guó)家外國(guó)專家局設(shè)立的外國(guó)文教專家事務(wù)仲裁機(jī)構(gòu)申請(qǐng)仲裁。
本合同于 年 月 日在 （地點(diǎn)）簽訂，一式兩份，每份都用中文和 文寫(xiě)成，兩種文本同等作準(zhǔn)。
